E-Sign Agreement

YOUR CONSENT TO ELECTRONIC DELIVERY ("Consent Statement")
You have applied for the Gemini Mastercard® Credit Card™ (the “Card”). If you consent to this Consent Statement, it applies even if you do not obtain (or are not offered) the Card.
In this Consent Statement, “we,” “us,” and “our” refer to: (1) WebBank, the issuer of the Card and (2) Gemini Constellation, LLC, the servicer of the Card.
You have the right to receive legal disclosures, notices, and communications and other items (together, the "Covered Items") in paper form by mail. We may instead provide these Covered Items to you electronically if you give us your Consent (defined below) to do so and satisfy the System Requirements below. For purposes of this Consent Statement, the Covered Items include all legal disclosures, notices, and communications that we are required to provide in writing regarding the Card account.
Your Consent will remain effective until the earlier of: (1) you or we have terminated your Card; or (2) you withdraw your Consent, as described in the next paragraph. If you terminate your Card, your Consent will still be valid with respect to the pre-termination rights of Gemini (including rights created by your Consent to this Consent Statement). See the cardholder agreement for information on how to terminate your Card.
You are free to withdraw your Consent at any time and at no charge to you.  If you do withdraw your Consent prior to the approval of your application, we will not be able to approve your application. If at any time you wish to withdraw your Consent, you may do this by opening your card settings and changing your paperless documents settings. If you decide to withdraw your Consent, the legal effectiveness, validity and/or enforceability of any prior electronic disclosures will not be affected.
Methods of Providing Covered Items
In this document, "provide" means to deliver, make available, send, notify or such similar term. We may provide the Covered Items electronically through any one of the following means: (1) your Designated Email Address, (2) your online account (whether accessed from our website or mobile application), or (3) other electronic notification methods. It is your responsibility to review the Covered Items promptly, so you can take appropriate action.
Access to Paper Copies
You may make copies of the Covered Items by using the "print" or "save" functionality of the application in which you are viewing the Covered Items (e.g. Web browser, Adobe® Reader® software). We retain copies of the Covered Items for the time periods required by law and will provide you with copies upon request within those time periods. We do not necessarily retain copies for longer than is required by law. Save or print copies of Covered Items to ensure you have them when needed.
You may request a paper copy at no cost of any Covered Item by calling us at 1-877-725-1116 or writing to us at Gemini Constellation, 600 Third Avenue, 2nd Floor, New York, NY 10016.
Our Right to Send Paper
We reserve the right to provide the Covered Items in paper form at all times at our discretion even if you have given us Consent to provide it electronically. For example, but without limitation, we may do this if we have a system outage or if we suspect fraud.
Hardware and Software Requirements
To access and retain the Covered Items, you must have a computing or communications device with:
  • working Internet access,
  • a Web browser that supports 128-bit encryption (we support the latest version of Chrome®, Firefox®, Microsoft Edge®, or Safari®),
  • 16 MB of available memory (32 MB of RAM recommended),
  • an email account for the Designated Email Address (defined below), and
  • a program that can view, save and print PDF files (such as Adobe® Reader® 4.0 or higher).

To demonstrate you can access Covered Items in a PDF format, click here ("Test PDF" document). If you are unable to view the Test PDF document, you need to install the necessary Adobe® Reader® software. You can download Adobe® Reader® by clicking here (clicking will open another browser window and take you to Adobe's website).
Your Contact Information
You certify the email address you provide for the Card ("Designated Email Address") is a valid email address. You must promptly inform us of any change in your Designated Email Address by opening your account settings and changing your communication preferences or calling us at 1-877-725-1116. If you allow someone else to access your Designated Email Address, you accept the risk that they may see your sensitive information.
Acknowledging Ability to Access and Consenting to Electronic Communications 
By checking the box, you consent and agree to receive Covered Items electronically and certify you (1) meet our System Requirements; (2) are able to access the Test PDF document linked above and print or store information presented to you and (3) will provide and maintain a valid Designated Email Address (collectively, your “Consent”).
You understand that by giving us your Consent, you may no longer receive such Covered Items in paper form and you accept any consequence of not reviewing the Covered Items in a timely manner.
