Gemini New User Incentive Program Terms

• Eligible new Gemini users who create an account, successfully complete onboarding, and achieve the minimum Qualifying Trade Volume worth of eligible trades within the applicable time period will receive the promotional reward specified in the offer they receive (e.g., “Get €15 worth of Bitcoin when you qualify”). 

• Unless otherwise stated, the time period is thirty (30) days from the date the user’s Gemini account is created and approved (“Time Period”). The reward amount will be calculated at the time of deposit by Gemini. “Qualifying Trade Volume” shall be such amount as disclosed in an applicable promo offer (e.g. “trade at least €100 in any crypto to qualify”).

• To activate the promotion and take advantage of this incentive, users must either enter a valid promo code or ensure the promo is auto-applied during signup, which may occur when registering (promo codes may auto-populate in certain circumstances). Failure to enter a promo code may result in ineligibility, and Gemini is under no obligation to retroactively apply any promotion

• This program is subject to and governed by the Gemini User Agreement, any other applicable Gemini terms and conditions, and these terms. This is a limited-time offer. Gemini reserves the right to withhold or revoke rewards if it determines, in its sole discretion, that a user has engaged in fraud, abuse, misuse, or other manipulative behavior in connection with this promotion. Void where prohibited or if Gemini determines that a customer is not eligible for the offer.

• The Euro-equivalent value of Qualifying Trade Volumes or any Bitcoin reward distributed under this initiative will be calculated based on a USD-denominated valuation determined by Gemini at the time of payout. Gemini does not guarantee any specific exchange rate or exact Euro value for any Qualifying Trade Volumes or Bitcoin reward. The exchange rate applied may differ from the prevailing market rate available on Gemini or other sources at that time. Gemini reserves the right to modify, suspend, or terminate this initiative at any time, without prior notice.

• Trades that count towards the trading threshold (Qualifying Trade Volume) include all revenue-generating trades activity: instant buy/sell/convert, market and limit trades, OTC trades, Active Trader trades, derivatives trades (in relevant jurisdictions where permitted), and other trades as agreed by Gemini in its sole discretion.

• Excluded activities: 

  • Fiat-stablecoin trades

  • Stablecoin-stablecoin trades

  • Deposits, withdrawals (crypto or fiat)

  • Other non-revenue-generating or otherwise ineligible transactions  as determined by Gemini in its sole discretion

• This offer is available only to new Gemini users who have not previously created a Gemini account. Users who were referred to Gemini from the Gemini Referral Program / Referral Club, or to users who have preexisting Gemini accounts under different email addresses, are not eligible. To be considered a new user, the customer must not have previously opened, registered, or maintained any Gemini account, under any email address or identity.

• In addition, to be eligible for a payout under this offer, users must have “Verified Full Tier” account status. Users who maintain only a “BasicPlus” level account, or any other verification status short of “Verified Full Tier,” will not be eligible for a payout, even if they otherwise meet the trading or other activity requirements. Gemini may offer different reward structures or amounts to users based on randomized assignment. The specific terms applicable to your promotion will be clearly disclosed in the offer presented to you.

• This program is only available in certain jurisdictions, as determined by Gemini in its sole discretion. Gemini may modify the list of eligible jurisdictions or make this reward available to users in other territories at any time, subject to applicable law.

• For users who meet the Qualifying Trade Volume threshold, rewards will generally be distributed within seven (7) days of meeting the threshold. However, distribution may take longer in certain circumstances, including but not limited to delays related to trade settlement, account verification, compliance reviews, system processing times, or other operational considerations. Timing of reward distribution is not guaranteed. Gemini will determine, in its sole discretion, the final eligibility for and timing of all rewards. 

• Gemini reserves the right to delay or withhold the distribution of any reward pending completion of any account verification, anti-money laundering review, or other compliance checks, in Gemini’s sole discretion. Gemini may review accounts and trading activity to detect patterns of abuse or manipulation. Accounts found to be engaging in such activity may be disqualified from this promotion and subject to additional account restrictions.

• Rewards are non-transferable, non-exchangeable for cash, and may not be substituted for any other form of credit or benefit.

• At the time of reward distribution, the user's Gemini account must be active, in good standing, and not subject to holds, suspensions, or other account restrictions.

• Meeting the Qualifying Trade Volume threshold does not guarantee reward distribution if other eligibility or compliance requirements are not satisfied.

• The value of Bitcoin received as a reward may fluctuate and is determined at the time of distribution. Gemini makes no guarantee as to the fiat value of the reward at any time after distribution. Nothing in this promotion shall be construed as investment or financial advice. Participants should consult with their own financial advisors before engaging in any trading activity.

• It's important to remember that any rewards earned through the Gemini New User Incentive Program may be subject to taxes in your country of residence. When you receive crypto rewards, the value of that reward may be considered taxable income. 

• It's recommended that you consult with a tax professional to determine the exact tax implications of receiving rewards from our program. Additionally, you are responsible for reporting any income earned through our program on your tax returns. Failure to do so may result in penalties or fines from your local tax authorities.  

• Gemini may modify or terminate this program any time in its sole discretion. Changes to the program may include, but are not limited to, eligibility, trade thresholds, reward amounts, or the timing and distribution process for rewards. A user’s continued participation in the rewards program does not grant any vested rights, and no user may rely on the continued availability of the program. Such changes shall be effective immediately upon posting to Gemini’s website and shall apply to all Gemini users.
