By placing an order on Gemini, you agree to the terms of your or and your , as applicable. In the event of a conflict between your Gemini user agreement(s) and the terms and conditions below, the terms of your Gemini user agreement(s) shall control.
Order Types
The following terms apply to the type of order placed on a Gemini platform:
A limit or target order will rest on the Gemini order book until it can be filed at the specified amount or is cancelled. It is not guaranteed to be filled. Funds associated with open limit and target orders will be on hold until they are filled or cancelled.
A market orders is filled immediately against resting orders on the Gemini platform at the current best available price. By placing this order, you accept the risk of price movement.
Once the Last Trade Price crosses the specified stop price, a stop-limit order will rest on the Gemini order until it can be filled at the limit price or is cancelled. It is not guaranteed to be filled. Funds associated with open stop-limit orders will be on hold until they are filled or cancelled.
A fill-or-kill (FOK) order is filled immediately at or better than the specified limit price. Any quantity that is not filled immediately is cancelled and does not rest on the continuous order book. It is not guaranteed to be filled. Funds associated with open FOK orders will be on hold until they are filled or cancelled.
An immediate-or-cancel (IOC) order is filled immediately at or better than the amount specified. If the order cannot be filled in full immediately, the entire quantity is cancelled. It does not rest on the continuous order book. IOC orders are not guaranteed to be filled. Funds associated with open IOC orders will be on hold until they are filled or cancelled.
A maker-or-cancel (MOC) order rests on the continuous order book. If any quantity of an MOC order can be filled immediately, the entire order is cancelled. MOC orders are not guaranteed to be filled. Funds associated with open MOC orders will be on hold until they are filled or cancelled.
Payment Methods
The following terms apply to the form of payment used to place the order:
Fiat Balance - By placing an order using the fiat balance in your Gemini account, you authorize Gemini to debit the transaction amount from your account balance.
Crypto Balance - By placing an order using a crypto balance in your Gemini account, you authorize Gemini to debit the transaction amount from your Gemini digital asset account balance. In the case of a Gemini Predictions transaction on the Gemini Titan platform, you authorize Gemini to sell the requisite amount of Gemini digital assets in your account to obtain the amount of fiat currency necessary to purchase the Gemini Predictions contract transaction amount. You also acknowledge that the sale of digital assets may qualify as a taxable event.
By placing this order, you also accept the risk of a failed transaction. In certain circumstances, Gemini may be able to successfully sell your digital assets but be unable to successfully purchase the Gemini Predictions contracts with the resulting USD. In those instances, you will need to complete the transaction using the resulting USD balance in your account and will be responsible for any price movement that occurs between your initial placement and completion of the Gemini Predictions contract.
Bank Account (ACH) - By placing an order using a bank account, you authorize Gemini to debit that account via Automated Clearing House (“ACH”). ACH deposits are made available for trading immediately; however, we reserve the right to hold funds in the amount of the ACH deposit and/or digital assets, as determined in our sole discretion, sufficient to cover the fund and to prevent withdrawal until the ACH deposit is settled. In certain circumstances, ACH deposit settlement times may be delayed.
If your ACH deposit is returned to your bank or fails for any reason, Gemini may, in its sole discretion, take steps to recover any amount owed. These steps may include canceling or reversing any transaction, including orders, made in reliance on or in expectation of receipt of the funds. Gemini may also liquidate or offset any digital assets or prediction contracts (or the proceeds thereof) purchased in reliance on or in expectation of receipt of the funds.
Debit Card - By placing an order using a debit card, you authorize us to debit the debit card account. Debit card transactions are executed immediately; however, we reserve the right to hold fiat currency in the amount of the debit card transaction and/or digital assets sufficient to cover these funds and to prevent withdrawal until they are settled. Debit card transaction settlement times may be delayed.
By placing an order using a debit card, you acknowledge that the right to claim funds back (a “chargeback”) is generally not permitted for completed transactions, other than for unauthorized use of the debit card or as explicitly permitted by applicable law.
Credit Card - Gemini does not permit the use of credit cards or proceeds from unsettled credit card-funded transactions to purchase digital assets. Credit card purchases are only available for Gemini Predictions contracts.
By placing an order for a Gemini Predictions contract using a credit card, you authorize Gemini to charge the credit card account. Credit card transactions are executed immediately; however, we reserve the right to hold fiat currency in the amount of the credit card transaction and/or digital assets sufficient to cover these funds and to prevent withdrawal until they are considered settled. Credit card transaction settlement times may be delayed.
By placing an order using a credit card, you acknowledge that chargebacks are generally not permitted for completed transactions, other than for unauthorized use of the credit card or as otherwise explicitly permitted by applicable laws and regulations.
Apply Pay / Google Pay - Apple Pay and Google Pay require a debit or credit card; Apple Cash and Google Pay balances are not supported. When using Apple Pay or Google Pay with a debit card, the terms and conditions of debit cards above apply. When using Apple Pay or Google Pay with a credit card, the terms and conditions of credit cards above apply.
PayPal - PayPal requires a linked funding source (debit card, credit card, or bank account). PayPal balance is not supported. When using PayPal with a debit card, the terms and conditions of debit cards above apply. When using PayPal with a credit card, the terms and conditions of credit cards above apply. When using PayPal with a bank account, the terms and conditions of bank transfers/ACH above apply.
Crypto Balance Error Message - In certain circumstances, you may have received a message stating, “Crypto sold, purchase incomplete.” If you receive such a message, it means Gemini was able to sell the digital assets associated with your Crypto Balance transaction but was unable to successfully purchase the Gemini Predictions contract(s) in your transaction. This can happen for a number of reasons, including, but not limited to, network conditions, rate changes, or account/limit checks. The USD from the sale of your digital assets remains in your account and can be used to purchase Gemini Predictions contracts directly to complete your requested transaction. Please try again using your USD, not your crypto balance.
