The Gemini Credit Card® Spend-NFT Promo Terms

To qualify for a limited edition NFT (the “NFT Offer”), you must (i) make $1,500 (the “Threshold Amount”) in qualifying purchases with your Gemini Credit Card within 31 days (the “Promotional Period”) and (ii) create a Nifty Gateway account, which includes agreeing to the Nifty Gateway Terms of Use, at niftygateway.com (“NG Account”), or log into your existing NG Account, and connect your NG Account to your Gemini account at gemini.com (“Gemini Account”) by December 16, 2022. The NFT Offer is only available for Gemini Credit Card accounts approved on or prior to October 6, 2022 and with a physical card activated on or prior to October 16, 2022. One Gemini Credit Card account per person. This is a limited time, non-transferable NFT Offer.
The Promotional Period starts from the later of: (a) the date you activate your physical card and (b) September 6, 2022. For example, if your account is approved and you activate your physical card on September 15, 2022, your Promotional Period would end on October 15, 2022. As another example, if on September 6, 2022 you are an existing cardholder with an activated physical card, your Promotional Period would end on October 6, 2022. For the avoidance of doubt, any purchases made on your digital card prior to activation of your physical card will not count towards the Threshold Amount.
The NFT Offer will be one of three NFTs from a limited collection, randomly selected; each of the three is of approximately equal value. The NFT Offer will be made available in a qualifying cardholder’s NG Account between November 14 and November 30, 2022. Failure to create a NG Account and connect it to your Gemini Account prior to December 16, 2022 will result in forfeiture of the NFT Offer. All federal, state and local taxes and any costs and expenses associated with your NFT Offer are your responsibility.
All Qualifying Purchase Transactions (as defined in the Rewards Program Terms) that post to your credit card account during the Promotional Period count toward the Threshold Amount; it can take 24-72 hours from the time of purchase for a transaction to post to your account. If you cancel or return purchases you made to meet the Threshold Amount or otherwise have credits (including if such credits are as a result of returning purchases made prior to the start of the Promotional Period) to your credit card account that cause you to not meet the Threshold Amount, you may only be eligible for the NFT Offer if you later meet the Threshold Amount within the Promotional Period. Qualifying Purchase Transactions do NOT include balance transfers, cash advances, fees or interest charges, transactions to obtain gift cards, prepaid debit cards, traveler’s checks, precious metals, casino chips, cryptocurrency, lottery tickets or other cash equivalents, unauthorized or fraudulent charges, and any other transactions that do not qualify for rewards under the Rewards Program Terms. If we in our sole discretion determine that you have engaged in fraud, abuse, misuse, or gaming in connection with this offer in any way or that you intend to do so, we may not issue your NFT Offer, may freeze any NFT Offer credited to your NG Account, or may remove any NFT Offer from your NG Account. To be eligible to receive the NFT Intro Offer, you must not be in breach of the Cardholder Agreement, the Rewards Program Terms, or the Nifty Gateway Terms of Use and your Gemini Credit Card account must not be past due, in default or closed at the time the NFT Offer would be made available in your NG Account. Additionally, your Gemini Account must not be closed or suspended for any reason at the time the NFT Offer would be deposited into your NG Account, and we reserve the right to withhold the NFT Offer if your Gemini Account is under investigation for any reason. This NFT Offer does not modify or supersede any terms of the Cardholder Agreement, Rewards Program Terms, Nifty Gateway Terms of Use or Gemini Trust User Agreement. Any controversy, dispute or claim arising out of or relating to these terms shall be subject to the dispute resolution provisions contained in the Dispute Resolution section of the Gemini Trust User Agreement which is incorporated herein by reference. Gemini reserves the right to modify or revoke the offer at any time.
